Terms of Service
Version 1

These terms set out how we work together when you book a website build with The Trade Marketer. They’re designed to keep things clear and fair on both sides.
Bookings & Payments

Payment terms vary by service and will always be confirmed in writing before work begins.

Website-in-a-Day projects are payable in full upfront to secure a dedicated build slot.
-
Standard website and business packages require a deposit (typically 50%), with the balance due before site launch and handover.
-
Support plans, fixed-scope packages, and time-based services may also require full payment in advance.
-
Until full payment has cleared, the website and any associated deliverables remain in my custody and will not be transferred or launched.
Project Start
A project is considered started once payment has been received and any preparatory work begins.

This may include (but is not limited to):

discovery or planning calls
-
background research or strategy preparation
-
sitemap or structure planning
-
content drafting or AI-assisted content development
-
platform setup (for example, Wix or Shopify)
Once work has begun, refunds are handled in line with the Cancellation section below.
Ownership & Intellectual Property
Ownership of the website refers to the live site and agreed deliverables; draft concepts, unused designs, internal frameworks, and working files remain the intellectual property of The Trade Marketer.

Once full payment is received, you own the finished website, including the content, design, and assets supplied or created for you.

I retain ownership of my internal processes, frameworks, and development methods. These are not transferable.

Any third-party tools, subscriptions, or apps remain under their own licensing terms.

Unless otherwise agreed, I may showcase your site in my portfolio.
Handover & Grace Period
-
You’ll have two opportunities to review the site:
-
A pre-launch review for sign-off.
-
A 14-day grace period after launch to flag any issues.
-

After the grace period, further changes may be chargeable.
-
The site will be indexed at launch so search engines are notified.
Future changes: Any post-launch changes to design, structure, or content may require reindexing. Responsibility for this sits with the client unless you are on a retention package, in which case I will handle it as part of the service.
Amendments & Extras
-
Minor tweaks that can be made quickly (a few minutes) may be included at my discretion.

Larger requests or new features not in the original brief will be quoted and charged separately.
Cancellations
By the Client
-
If you cancel before work has started, you may request a refund in line with your payment type (deposit or full payment).
-
Once work has begun, payments become non-refundable or pro-rata, depending on the service booked.
-
Website-in-a-Day and other fully prepaid, fixed-scope services become non-refundable once preparation has started, as time and resources are reserved exclusively for your project.
By The Trade Marketer

I reserve the right to cancel a project if:
-
I am required to chase repeatedly for content or essential information.
-
There are ongoing changes of direction or revisions that prevent progress.
-
Behaviour or communication makes it unreasonable to continue.
-
In these cases, clear notice will be given. Work completed up to that point will be invoiced, and the project may be treated as a new build if restarted later.
Payments
-
All invoices are payable within 15 days of the invoice date.
-
If payment is not received within this time:
-
The website may be withheld (not transferred or launched).
-
If payment remains outstanding after 60 days, I reserve the right to begin debt recovery, including through the UK Small Claims Court.

Any recovery costs will be added to the outstanding balance
-
Digital services, fixed-scope builds, and booked production time are exempt from cooling-off periods once work has begun, in line with UK consumer regulations for bespoke services.
Fees & Hosting
-
Websites are built on Wix, Wix Studio, Shopify, or another agreed platform, depending on the scope and needs of your project.
-
Platform subscriptions, domains (URLs), and any paid third-party apps are not included in your website build fee unless explicitly stated in writing.
-
Where Wix offers a free domain as part of its own promotional plans (for example, on certain annual subscriptions), this is provided directly by Wix and remains subject to their terms.

If you book a multi-year website package through The Trade Marketer, your domain may be included for the same duration. This will always be confirmed in writing before work begins.

All platform and domain arrangements are agreed in advance so there are no surprises.
-
Final payment must be received in full before website launch and handover. An advance payment link will be issued to complete this step.
Discovery Meetings

Clients can book a free Discovery meeting directly through my online calendar.
-
A confirmation will be sent by email once the booking is made.
-
I will always endeavour to honour every appointment. If unforeseen circumstances arise, I will give as much advance notice as possible.

As a courtesy, I ask clients to give at least 24 hours’ notice if they cannot attend or no longer need the appointment.
Complaints & Resolution

If you are unhappy with any part of the service, please raise your concern in writing (by email or via WhatsApp) as soon as possible. Contact information here ⇨

Complaints should be made within a reasonable time — ideally within 14 days of the issue arising.

I will review your complaint promptly and work with you to reach a fair resolution.
Performance & Guarantees

While every site is built with strategy in mind, I cannot guarantee any specific number of sales, leads, or enquiries.

Website performance depends on many factors, including ongoing marketing and how the site is maintained once handed over.
Data Protection & Cookies

I comply with the UK General Data Protection Regulation (UK GDPR) when handling personal data.

Any information you provide to me (for example, through forms, emails, or during the build process) will be used only for the purpose of delivering your project.

If I need to use test data while building your site, it will be removed before handover.

Once the site is live, you become responsible for the data collected through it. This includes ensuring compliance with data protection law and maintaining suitable policies such as a Privacy Policy for your business.

I do not sell or share your data with third parties, other than where required to provide the agreed services (for example, through Wix or other integrated tools).

Client Responsibility

After handover, clients are responsible for maintaining accessible content. This includes:

If you are on a retention package with me, I will manage these responsibilities on your behalf as part of the service.

Ownership of Your Website

Once full payment is received, you own the finished website, including:

The site design and layout.

The content, images, and branding you have supplied.

Any bespoke graphics, text, or multimedia I have created specifically for your project.

You are free to use, edit, and develop your site as you wish after handover.
What Remains with The Trade Marketer

Draft or unused design concepts, notes, and background research.

These materials are not transferable and remain the intellectual property of The Trade Marketer.
Third-Party Materials

Some sites include third-party materials such as stock images, fonts, apps, or plugins.

These items are covered by their own licences and terms of use. Where applicable, I will confirm the source and usage rights.

Clients are responsible for maintaining these licences (unless otherwise agreed).
Content Creation & Generative AI

All content created for your site — whether text, imagery, graphics, or video — is developed in line with your branding guidelines, tone of voice, and project needs.

I may use Generative AI tools (for example, to support image creation or draft content ideas). These tools are used under licence and always directed, edited, and refined by me.

This process is not a “quick fix.” I work carefully to ensure all outputs are:

Original and unique to your project.

Free from plagiarism.

Tailored to your brand and audience.

The finished materials supplied are considered original works produced by The Trade Marketer and fall under the same copyright ownership rules as other project deliverables
Copyright Protection

All content and designs produced by The Trade Marketer remain protected under UK copyright law until full payment is received.

I reserve the right to take action if any work is used, published, or duplicated without authorisation.
Portfolio Use

I may showcase your completed site as part of my portfolio, unless you request otherwise in writing.
Agreement to Policies
By signing the Service Agreement issued at the start of your project, you confirm that you have read, understood, and accepted the policies set out on this page. These policies form part of the overall agreement between you (the client) and The Trade Marketer.

Do I own my website once it’s built?
Yes. Once you’ve paid in full, the website is yours. I retain ownership of my processes, frameworks, and background development work.

It secures your build slot and covers initial planning, research, and design setup. It’s non-refundable once more than 3 hours’ work has been completed.
Can I make changes after my website goes live?

Will my website show up in Google automatically?
